List of Cases Requiring a Notarized Power of Attorney in Russia
Transactions and Property
Transactions requiring notarial form. If a contract must itself be notarized by law (e.g., life annuity contract, pledge of a share in an LLC, prenuptial agreement), the power of attorney to execute it must also be notarized.
Applications for state registration of rights or transactions. Submitting documents to Rosreestr (the Russian property registry) to register the transfer of ownership, mortgage, or lease of real estate.
Disposition of registered rights. Sale, gift, or pledge of real estate or a vehicle whose rights are recorded in state registries.
Delegation of authority (substitution). Transferring powers to a third party (except delegation by legal entities as prescribed by law).
Irrevocable power of attorney. A power of attorney that cannot be revoked before its expiration (Art. 188.1 of the Civil Code).
Banks and Finances
Managing bank accounts and deposits (broad scope). A bank-issued power of attorney is valid only within a specific bank. To manage accounts across multiple banks, you need a notarized power of attorney.
Claiming deposit insurance compensation after a bank license revocation. To apply to the Deposit Insurance Agency on behalf of a depositor, you must provide a notarized power of attorney.
Operations with unallocated metal accounts (UMA). Managing precious metals by power of attorney requires a notarial form — a bank-issued one will not suffice.
Representation of an individual before tax authorities (Sec. 3, Art. 29 of the Tax Code). A power of attorney from an individual for interaction with the Federal Tax Service must be notarized.
Multifunctional Centers — MFC ("My Documents")
State registration of real estate rights through an MFC. A notarized power of attorney is required to submit and receive documents to register ownership, transfer rights, or mortgage.
State registration of a legal entity or sole proprietor through an MFC. A representative submitting or receiving documents must present a notarized power of attorney (or a notarized copy).
Amendments to the Unified State Register of Legal Entities (USRLE) through an MFC. The applicant's representative must provide a notarized power of attorney or a notarized copy.
Regular MFC services — obtaining certificates, extracts, applying for subsidies, etc. — do not require a notarized form; a simple written power of attorney is sufficient. A notarial form is needed only when the service itself involves registration of rights or transactions.
